Court Case Exposes ‘Compromised’ Prosecutor Reza
The trial of land developer George Katsimberis has opened a can of worms with the businessman alleging that prosecutor Michael Reza has been curtailing his efforts to seek justice against controversial businessman Kenneth Raydon Sharpe.
Katsimberis is making an application for referral to the Constitutional Court after feeling that Reza’s prosecution was compromised.
In his application for referral to the ConCourt, Katsimberis raised a red flag against Reza saying the acting deputy prosecutor general had blocked the prosecution of Kenneth Raydon Sharpe and his business partner Olexander Sheremet.
The land developer highlighted how Reza had caused the arrest of City of Harare chief building inspector Roy Nyabvure a key witness in Katsimberis’ other cases against companies linked to Sharpe.
Advocate Tinomudaishe Chinyoka who is representing Katsimberis and leading cross examination asked the latter on what charges Nyabvure to which he responded
“Nyabvure was arrested coming out of Court and he was charged with Criminal abuse of off and not following City of Harare procedures on building plans,” said Katsimberis
It was revealed that Denzel Malikwa a legal practitioner and an employee at Sharpe’s company is the complainant in Nyabvure’s criminal abuse of office case with Chinyoka asking why a person who doesn’t work for the City of Harare become a complainant in the matter.
Chinyoka then proposed to the presiding Magistrate Wongai Guwuriro that he wishes to have Malikwa in the witness stand.
Reza stood up objecting to the proposal saying it is only the State that will be the complainant in cases before the courts but an alert Chinyoka dismissed his assertions.
“The State does not go around reporting cases to the police, there is always a person that reports and the State in court on behalf of that person seeks to uphold justice for everyone since a crime has been committed…” said Chinyoka
Sharpe and Katsimberis have several court cases against each other where they appear either as complaints or the accused following a botched joint venture agreement.
